Online Gold Loan T&C
These Terms and Conditions (the "Terms") shall apply to and regulate the Fedbank “Top-Up Gold Loan” ("Top-Up Loan") or “Additional Gold Loan” (“Additional Loan”) or Renewal for existing Gold Loan provided by Fedbank Financial Services Limited (“Fedbank”) and are in addition to and not in derogation of the Terms and Conditions governing the Gold Loan of Fedbank (the "Primary Terms and Conditions") as available on www.fedfina.com/terms-conditions/. To the extent of any inconsistency between these Terms and the Primary Terms and Conditions, these Terms shall prevail.
"Application" shall refer to the application made by a customer to Fedbank for availing an Online Top-Up Gold Loan / Additional Gold Loan. The Application shall be in the form of a request made in the manner and format prescribed by Fedbank on it’s website (www.fedfina.com) and/or mobile application, and shall form an integral part of these Terms and Conditions.
“Customer” for the purpose of availing Top-Up Loan shall mean, a person who has availed an existing Gold Loan from Fedbank and has his Mobile number registered with Fedbank.
“Customer-ID” or “Login ID” or “UCID” means as unique identification number assigned to every customer
“Online Platform” or “Software” shall mean and include Online Platform” or “Software” shall mean and include the website and mobile application. The website can be accessed from any search engine whereas the mobile application can be downloaded from app stores [i.e. Playstore (Android) or App Store(iOS)]. And can be accessed from any platforms where the Application functions such as desktop, mobile phones, tablets and any such other devices.
"Personal Information" shall mean and include the information provided by the Customer to Fedbank.
“Scheme” is specified at https://www.fedfina.com/gold-loan/
“Online Gold LoanServices” shall mean and include all the services that customer can access and avail by login through website and mobile application
“Unauthorised Use” means any usage of Online Gold Loan Services which is not in accordance with the Terms.
“Website” shall mean and include website and online transaction portal maintained by Fedbank Financial Services Limited or any vendor appointed by Fedbank Financial Services Limited from time to time
2. Live photo uploading Guidelines:
To avail the Top-Up Loan, the Customer has to click his Live Photo only. The Customer is not authorised to choose an image from the gallery and upload. The Customer shall ensure that, the Live Photo is not blurred. The file size of the Live Photo shall not exceed 2MB. The Customer shall not use any other image to be captured/third party images captured in the Live Photo. The Customer shall ensure the Live Photo does not include any anti-social element(s)/ object and should not be obscene in nature. If the Live Photo is rejected for whatsoever reason, an alert will be sent to the registered mobile number of the Customer.
The Customer shall be deemed to have unconditionally agreed to and accepted these Terms and Conditions by submitting the Application for availing Top-Up Loan/Additional Loan and/or by performing a transaction, in the form and manner prescribed by Fedbank from time to time.
The Customer hereby represents and warrants that he/she is fully aware that, the instant live photo clicked by him/her shall be affixed to his/her Top-Up Loan Application / Additional Loan Application and hereby grants permission to Fedbank to affix/ reproduce the Live Photo on the Top-Up Loan / Additional Loan Application.
Fedbank shall not be liable for any claims relating to the Live Photo shared by the Customer. The Customer shall be solely responsible for the Live photo, Fedbank is merely affixing the same on the Application at the request of the Customer and shall not be liable for any claims relating to the Live photo.
The Customer confirms that use of the Live Photo shared by the Customer shall not be in violation of any intellectual property rights of the Live Photo. The Customer understand that Fedbank shall have the right to reject, refuse, cancel the Online Loan Application and Fedbank may recall the Online Top-Up Loan if granted, if the Live Photo shared by does not meet the aforesaid guidelines.
Fedbank may in its sole discretion decline/refuse to grant Online Top-Up Loan / Additional Loan, without assigning any reason whatsoever to the Customer.
The Customer agrees that the Live Photo shared, is free from any Spyware, Malware, Virus or any other content which is harmful to Fedbank.
3. Issuance of Online Top-Up Loan(s) / Additional Loan/Renewal of Existing Gold Loan:
Fedbank may issue the Top-Up Loan(s) / Additional Loan/Renewal of Existing Gold Loan pursuant to the Customer making an Application for Online Top-Up Loan / Additional Loan/ Renewal of Existing Gold Loan and agreeing to the applicable terms and conditions in the form and manner prescribed by Fedbank in this regard. Fedbank shall maintain records of these Applications and other consents/instructions in such manner as may be deemed suitable by Fedbank.
The Customer is entitled to choose the Scheme as per his/her requirement and agrees to pay the charges applicable to the selected scheme/s.
The Online Top-Up Loan/Additional Loan amount shall be disbursed in the account number registered with Fedbank. The Top-Up Loan/Additional Loan amount shall be disbursed within 8 days from the date of submission of the Loan Application, subject to adherence of the terms and conditions mentioned herein.
The Customer shall be bound to comply with these Terms and Conditions and all the policies stipulated by Fedbank from time to time in relation to the Top-Up Loan/ Renewal of Existing Gold Loan. Fedbank may, at its sole discretion, refuse to accept the Application or to issue Top-Up Loan/ Renewal of Existing Gold Loan to the Customer.
3.5 The Customer agrees that in the event the Customer avails of any services/ facilities offered by Fedbank through the Website, the Customer shall be bound by all the terms and conditions stipulated by Fedbank pertaining to such services/facilities, offered by Fedbank and availed by the Customer through the Website.
4. Application for Online Top up Loan/ Additional Loan/Renewal of Existing Gold Loan:
The Customer acknowledges that, all future Loans availed by the Customer through Online, shall be linked under a Unique Customer Identification Code to identify the Customer, avoid multiple identities, track the facilities availed, monitor financial transactions in a holistic manner and enable Fedbank to have a better approach to risk profiling of the Customer.
The Customer acknowledges that the underlying Online Platform / Software required for accessing Fedbank Online Platform is the legal property of the Fedbank. The permission given by Fedbank to access the Online services will not convey any proprietary or ownership rights in the above Software to the Customer. The Customer shall not attempt to modify, translate, disassemble, decompile or reverse engineer the Online Platform or create any derivative product based on the Software.
The Customer shall have the option of applying for facilities provided by Fedbank on Online Top-Up Loan / Additional Loan/Renewal of Existing Gold Loan. The facility shall be extended to the Customer subject to the Customer complying with Fedbank’ s Gold Loan parameters and submitting all documents as may be required by Fedbank in such form as may be specified by Fedbank from time to time. Fedbank may in its sole discretion reject the application for the facility by the Customer.
The Customer can check the availability of a pre-approved offer that may be made by Fedbank to the Customer through Online Gold Loan Services. The eligibility of a Customer for a facility provided by Fedbank shall be decided by Fedbank at its sole discretion. Any pre-approved offer by Fedbank to the Customer does not constitute grant of facility to the Customer and shall be subject to the Customer complying with Fedbank credit parameters and submitting all documents required by Fedbank in such form as may be specified by Fedbank from time to time.
The Customer expressly agrees and acknowledges that in the event the Customer desires to apply for Online Top-Up Loan/ Additional Loan/Renewal of Existing Gold Loan, then the Customer is required to submit the relevant documents either through Online or in any other manner as specified by Fedbank from time to time. In the event, such Online Top-Up Loan/ Additional Loan/Renewal of Existing Gold Loans sanctioned/disbursed by Fedbank to the Customer, the Customer expressly agrees and acknowledges to have read and understood the terms and conditions governing the Online Top-Up Loan/ Additional Loan/Renewal of Existing Gold Loanandshall be bound by such terms and conditions at all times during the tenure of the Loan, and/or as may be amended by Fedbank from time to time. Further, the Customer agrees to execute any other document as may be required by Fedbank.
The Customer irrevocably and unconditionally authorises Fedbank to access all his Loan accounts for effecting Online Gold Loan services or other transactions performed by the Customer through the Online Gold Loan services. The instructions of the Customer shall be effected only when such instruction is in accordance with the prescribed procedure.
The Customer further agrees that, the Customer is responsible for the accuracy and authenticity of the instructions provided to Fedbank. Fedbank shall have no obligation to verify the authenticity of any transaction/instruction received or purported to have been received from the Customer through its dedicated login provided to the respective Customers for opting the Online Gold Loan Services or purporting to have been sent by the Customer other than by means of verification of the Online Gold Loan Services Login ID and the OTP/ Password.
The read-out, SMS, email output or the printed output, if any, that is received by the Customer at the time of operation of Online Gold Loan Services is a record of the operation of the computer/ mobile by the Customer and shall be accepted as conclusive and binding for all purpose. All the records of Fedbank generated by the transactions arising out of the use of the Online Gold Loan Services, including the time the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transaction. While Fedbank shall endeavour to carry out the instructions promptly, they shall not be responsible for any delay in carrying on the instructions due to any reason whatsoever, including due to failure of operational systems or any requirement of law.
Rules and regulations of banking transactions including RTGS/IMPS/NEFT regulations will be applicable to the transactions performed while availing Online Gold Loan services.
5. Customer Login ID (CUST-ID) and OTP
The Customer shall keep his/her Customer-ID/Login ID/ UCID, Loan Account Number, One Time Password (OTP), Password, secured, totally confidential and shall not reveal it to any third party. Fedbank and/or its employees, officials never calls or ask Customer to share the Password or OTP sent to the Customer on the registered number. Customer should never share the Password/OTP with anyone as this may lead to financial frauds.
The Customer agrees and acknowledges that Fedbank shall in no way be held responsible or liable if the Customer incurs any loss as a result of compromise of Customer-ID/ Login ID/UCID, Password and OTP by the Customer himself or Customer has failed to follow the Online Gold Loan services instructions as published by the Fedbank on the site from time to time. The Customer agrees to fully indemnify and hold harmless Fedbank in respect of the same.
In the event, the Customer has captured incorrect credentials on the Online portal, the Login ID shall get locked after 3 (three) incorrect attempts. The same shall be available on the next day. In case of emergency, the Login ID can be unlocked by visiting the nearest branch.
In the event, the Customer has closed all his existing Gold Loan with Fedbank, then the Customer unique Login ID will expire. Fedbank may at its discretion deactivate the Login ID, if the Customer has not logged in the Online account for a period 6 months.
In consideration of Fedbank providing the Top-Up Loan/Additional Loan/Renewal of Existing Gold Loan to the Customer in relation to the Scheme opted by the Customer, the Customer hereby agrees to indemnify and keep Fedbank indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs (including legal costs) (hereinafter 'Claim'), charges and expenses whatsoever which Fedbank may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of:
any violation, breach or alleged breach of the Terms by the Customer;
providing the Customer the said facility of the Top-Up LoanAdditional Loan/Renewal of Existing Gold Loan;
the negligence, mistake or misconduct of the Customer (directly or indirectly);
any Claim relating to infringement or alleged infringement of photo uploaded by the Customer,
violation of any legal, statutory or regulatory guidelines regarding use of Live Photo;
any action, suit or claim by any third party arising out of the usage of the Live Photo by Fedbank;
any Claim where the Customer has violated the Live Photo sharing guidelines;
breach or non-compliance of these terms and conditions;
fraud or dishonesty relating to any transaction by the Customer or his associated person;
7.Limitation of Liability:
Fedbank shall be under no liability whatsoever in respect of any/all actions, claims, demands, proceedings, losses, damages, personal injury (including actual or perceived loss of reputation, defamation or the like) (hereinafter 'Dispute') and costs, charges and expenses whatsoever, arising directly or indirectly out of:
any use of Customer ID/Login ID/UCID, Password and/or OTP;
any Dispute relating to infringement or alleged infringement of the Live Photo and legal or regulatory guidelines regarding use of Live Photo;
Any Disputes from third parties relating to the credit and reputation (including actual or perceived loss of reputation, defamation or the like), alleged to have been caused by the Live Photo. The settlement of this Dispute shall be the sole responsibility of the Customer, on whose instruction the Live Photo is affixed on the Top-Up Loan/Additional Loan/Renewal of Existing Gold Loan Application;
Any mis-statement, mis-representation, error or omission in any details disclosed to Fedbank.
Fedbank shall under no circumstance be held liable to the Customer if the Online Gold Loan Services is not available in the desired manner for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the control of Fedbank. Under no circumstances shall Fedbank be liable for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the Customer or by any other person. Illegal or improper use of the Online Gold Loan Services shall render the Customer liable for payment of financial charges as decided by Fedbank or will result in suspension/termination of the Online Gold Loan Services extended to such Customer/s. The aforesaid does not limit Fedbank’s right to initiate appropriate legal proceedings against such Customers.
8. Fees & Charges:
All fee, charges applicable to the Scheme are specified at scheme chooser page on our website.
Any government charges, duty or debits, or tax payable as a result of the availing the Top-Up Loan shall be the Customer’s responsibility and if imposed upon Fedbank (either directly or indirectly), Fedbank shall subject to prevailing charges as applicable in respect of the Top Up Loan, debit such charges, duty or tax from the Top up Loan availed prior to disbursal of the Loan.
9.Intellectual Property Right:
The Customer should assume that everything he/she views or reads on the online platform (collectively referred to as "Content") is copyrighted/protected by intellectual property laws unless otherwise provided and may not be used, except as provided in these terms, without the prior written permission of Fedbank.
Fedbank reserve the right to hold all copyright on the Content displayed on the Online Platform. Nothing contained on the Platform or Website(s) should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any intellectual property displayed on the Website(s) without the written permission of Fedbank or such third party that may own the intellectual property displayed on the Platform.
Fedbank grants the right to access the Platform to the Customer and use the Online Services in accordance with the terms of service mentioned herein. The Customer acknowledges that the services including, but not limited to, text, content, photographs, video, audio and/or graphics, are either the property of, or used with permission by, Fedbank and/or by the content providers and may be protected by applicable copyrights, trademarks, service marks, and/or other proprietary rights and laws of India.
Any breach of the restrictions on use provided in these terms is expressly prohibited by law, and may result in severe civil and criminal penalties. Fedbank shall be entitled to obtain equitable relief (including all damage, direct, indirect, consequential and exemplary) over and above all other remedies available to it, to protect its interests therein.
10. Technology Risks
The website of the Fedbank may require maintenance and during such time it may not be possible to process the request of the Customers. This could result in delays and/or failure in the processing of instructions. The Customer understands that the Fedbank disclaims all and any liability, whether direct or indirect, whether arising out of loss or otherwise arising out of any failure or inability by the Fedbank to honour any Customer instruction for whatsoever reason.
The grant of Online Gold Loan Services to a Customer is not transferable under any circumstance and shall be used only by the Customer.
12. Notification of Changes and Other Provisions
Fedbank shall have the absolute discretion to amend or supplement any of these Terms and Conditions, features and benefits offered to the Customer including, without limitation to, changes which affect interest charges or rates and methods of calculation at any time.
Fedbank shall notify/communicate the amended Terms and Conditions by hosting the same on the Fedbank's website or in any other manner as decided by Fedbank. The Customer shall be responsible for regularly viewing these Terms and Conditions, including amendments thereto as may be posted on Fedbank’s website and shall be deemed to have accepted the amended Terms and Conditions by continuing to use the Top-Up Loan / Additional Loan. If any provision of these Terms and Conditions shall be determined to be invalid or unenforceable under any rule, law, or regulation of any governmental agency, local, or state, the validity or enforceability of any other provision of these Terms and Conditions shall not be affected.
13. Third Party Links
The Online Portal may provide hyperlinks to websites not controlled by Fedbank and such hyperlinks do not imply any endorsement, agreement on, or support of the content, products and /or services of such websites. Fedbank doesn’t editorially control the content, products and /or services on such websites and shall not be liable, in any nature whatsoever, for the access to, or the inability to access to, or the use, inability to use or content available on or through such websites.
14. Termination of Online Gold Loan Services
The Customer may request for termination of the Online Gold Loan Services any time by giving a written notice to Fedbank at any of its branches. The Customer will remain responsible for transactions made on his/her account(s) prior to the time of such cancellation of the Online Gold Loan Services.
Fedbank may at its sole discretion, at any time without giving notice or reasons suspend or terminate all or any of the Online Services offered by the Fedbank and/or use by the Customer including for reasons such as:
Breach of these terms by the Customer &
Knowledge or information about the death, bankruptcy or legal incapacity of the Customer
Notices to the Customer may be given through any medium of communication as may be deemed appropriate by the Fedbank i.e. Fedbank’ s website (www.fedfina.com) or email, sms, public notification at Branches, or through newspapers, radio, TV etc. Such notices will have the same effect as a notice served individually to each Customer.
16. Force Majeure
The Fedbank shall not be liable for delay in performing or failure to perform any of its obligations under these Terms of Service (Terms & Conditions) which is caused by circumstances beyond its reasonable control, including, but not limited to, the failure, malfunction or unavailability of telecommunications, data communications and computer systems and services, natural calamities, war, civil unrest, government action, strikes, lock-outs or other industrial action or trade disputes (whether involving the Fedbank’s employees or those of a third party). Any delay or failure of this kind will not be deemed to be a breach of the Terms of Service (Terms & Conditions) and the time for performance of the affected obligation will be extended by a period which is reasonable in the circumstances.
17. Disclaimer on The Information Technology Act 2000
The Fedbank has adopted the mode of authentication of the Customer by means of verification of the Login ID and or through verification of OTP or through any other mode of verification as may be stipulated at the discretion of the Fedbank. The Customer hereby agrees/consents for the mode of verification adopted by the Fedbank. The Fedbank agrees that the transactions carried out or put through by the aforesaid mode shall be valid, binding and enforceable against the Customer and the Customer shall not be entitled to raise any dispute questioning the transactions.
18.Disclaimer on Anti-Virus Update
The Customer needs to get his PCs/laptops/ mobile scanned on a regular basis and be updated with the latest antivirus software available. The Fedbank shall not be responsible in case of any data loss or theft due to the virus transmitted in the system through the usage of Online Gold Loan Services.
Online Payment T&C
"User" refers to a customer of Fedbank Financial Services Limited and/or of the Affiliates authorised to use website (defined below) by these Terms. In case of the customer being a minor, the guardian of such minor shall be permitted to use Online transaction portal upon accepting these Terms and will be considered as a 'User'. Account(s) or "Accounts" or “Account" refers to the User’s loan/facility account(s), and/or any other type of account(s), so maintained with Fedbank Financial Services Limited or its Affiliate. “Terms" refer to terms and conditions herein for use of online transaction portal. “Website" refers to the website and online transaction portal maintained by Fedbank Financial Services Limited or any vendor appointed by Fedbank Financial Services Limited from time to time. “Unauthorised Use” means any usage of Online transaction portal which is not in accordance with the Terms. "Facility" shall mean the online transaction facility provided by Fedbank Financial Services Limited to the Users, by the use of which the Users can Pay/deposit funds to their Loan Account through the modes specified below.

It will be the responsibility of the customer to ensure that no double payment is made from his end for the same Account.
Fedbank Financial Services Limited reserves the right to change the above-stated charge.
All disputes arising out of the said services shall be subject to the exclusive jurisdiction of competent courts in Mumbai.
TERMS & CONDITIONS
Once the payment has been made, no cancellation will be entertained for any reason.
The User shall take all necessary precautions to prevent Unauthorised Use and unauthorized or illegal access by any person other than the User.
The User shall ensure that services on website or any related service is not used for any purpose which is illegal, improper or which is not authorised under these Terms.
During Online Payment, if the amount is debited from customer bank account and the transaction details are not generated online, in such an event it will take 24 hours to generate transaction details with bank and payment gateway. If the Online transaction details are not generated, even after 24 hours or money is not refunded to the bank account, please contact/reach our Customer Care at given below credentials.

DISCLAIMER OF WARRANTIES
The Client expressly agrees that use of the Website is at its sole risk.
The Website is provided on an "as is" and "as available" basis. Except as warranted in the Terms above, Fedbank Financial Services Limited expressly disclaims all warranties of any kind, whether express or implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy and completeness, and any warranties relating to non-infringement. Fedbank Financial Services Limited does not warrant that access to the Website shall be uninterrupted, timely, secure, or error free nor does it make any warranty as to the results that may be obtained from the Website or use, accuracy or reliability. Fedbank Financial Services Limited does not guarantee to the User or any other third party that online transactions would be virus free Fedbank Financial Services Limited will not be liable for any virus that may enter the User's system as a result of the User using online transactions.
